Terms of Service — Vektur RaceTracker

Application: racetracker.vektur.app (“the App”). Operator: Lilliput Software (“we”, “us”, or “our”). Contact: Support@lilliputsoftware.com.

1. Acceptance of Terms

By accessing or using racetracker.vektur.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the App.

2. Access and Eligibility

• Club/Association Approval: The App is currently made available exclusively to members of yacht clubs, sailing classes, or associations approved by Lilliput Software and their crews and support personnel. We reserve the right to grant, restrict, or revoke access to any club, association, or individual user at our sole discretion.
• Pricing: Access to the core features of the App is currently provided free of charge. Lilliput Software reserves the right to introduce fees, subscription models, or paid premium tiers in the future for certain markets or features upon reasonable notice.

3. Critical Disclaimers: Non-Navigational & Accuracy Limits

• NOT FOR NAVIGATION: The App is strictly an educational, race replay, and debriefing tool. It is NOT designed, certified, or intended for maritime navigation, collision avoidance, or safety of life at sea. Do not rely on the App, its maps, its depth contours, or tide feeds for navigational safety.
• NO LIABILITY FOR DATA ERRORS: Race replays, calculated positions, wind vectors, and mark locations may contain substantial inaccuracies. Tracking data uploaded to the App is generally sampled at a low frequency (e.g., 1Hz or lower), and mark locations may be approximated or deduced algorithmically.
• PROTEST HEARINGS & OFFICIAL RESULTS: The App and its replay outputs are not accurate enough to be relied upon as conclusive evidence in protest hearings, rule disputes, or arbitrations under the World Sailing Racing Rules of Sailing (RRS), unless explicitly supported by corroborating high-resolution instrument telemetry and officially accepted by the organizing authority / protest committee. Lilliput Software accepts no liability whatsoever for race scoring, disqualifications, or protest outcomes influenced by data from the App.
• AI ANALYSIS DISCLAIMER: The Fleet Overview, Boat Debriefs, and strategic commentary features are generated via artificial intelligence (including the Anthropic API). AI analysis is inherently experimental, prone to hallucination or tactical errors, and should be treated as automated commentary rather than professional coaching advice.

4. Uploaded Content and Tracking Data

• Ownership & License: You retain ownership of any track files (GPX, FIT, CSV), crew data, and comments you upload. However, by uploading tracking data to the App, you grant Lilliput Software a non-exclusive, worldwide, royalty-free, perpetual license to host, display, reformat, analyze, and replay this data.
• Public Replays: You acknowledge and agree that race replays, mark roundings, boat names, sail numbers, and helm/crew names may be published publicly or within club portals by your club administrators, class administrators, other participants, or Lilliput Software.
• Crew Consent: You warrant that you have obtained appropriate consent from your boat’s crew members before submitting their names and details to the platform.

5. Third-Party Hardware and Integrations

The App allows track uploads and direct API integrations from third-party loggers and platforms (including but not limited to Cycplus, Vakaros Atlas 2, Sailtech GPS Compass, and RaceSense). Lilliput Software is an independent provider and is not affiliated with, endorsed by, or liable for the performance or malfunction of any external hardware or third-party cloud service.

6. User Conduct

You agree not to:

• Use the App for any illegal, hazardous, or unauthorized purpose.
• Interfere with, reverse engineer, or overload the platform infrastructure (hosted on Google Cloud / Firebase).
• Upload malicious code, corrupted track files, or abusive content.

7. Limitation of Liability

To the maximum extent permitted by applicable law in England and Wales:

• The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.
• Lilliput Software, its officers, employees, and suppliers shall not be liable for any direct, indirect, incidental, special, or consequential damages, including loss of race results, trophies, damage to marine vessels, personal injury, or data loss arising out of or related to your use of the App.

8. Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if you breach these Terms or if we discontinue the Service.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
